Terms of Service

Note: This document is a starting template tailored to PayChest. It is not legal advice. Have a qualified lawyer review it, and fill in the operator details, governing law and effective date, before relying on it.

These Terms of Service (the “Terms”) govern your use of PayChest — a Telegram Mini App and bot (@pay_chest_bot) that lets creators sell subscriptions, digital products and donations, and lets supporters pay for them, using USDT on the TON, TRON (TRC-20) and BNB Smart Chain (BEP-20) networks. PayChest is operated by the operator of PayChest (“we”, “us”). By using PayChest you agree to these Terms. If you do not agree, do not use the service.

1.What PayChest is (and is not)

PayChest is software that connects creators and their supporters and helps arrange on-chain payments. PayChest is non-custodial: payments for a creator’s offers are transferred directly, on-chain, from the payer’s wallet to the creator’s wallet. We never take custody of, hold, or control those funds, and we are not a bank, money transmitter, payment processor, escrow, or exchange.

A purchase is a transaction between the buyer and the creator. We are not a party to it. We provide the tools (checkout, on-chain verification, delivery of access, and — for digital products — hosting of files for delivery), not the goods or services being sold.

2.Eligibility & accounts

You must be at least 18 years old (or the age of majority where you live) and legally able to enter a contract.
You access PayChest through your Telegram account and one or more crypto wallets you control. You are responsible for keeping them secure. Anyone with access to your Telegram or wallet may act as you.
You are responsible for complying with the laws that apply to you, including tax reporting on any income you earn.
You represent that you are not located in, a resident of, or acting on behalf of any country, territory or person subject to applicable sanctions or trade embargoes, and that you are not on any sanctions or restricted-parties list.

3.Creators

If you offer subscriptions, products or donations, you are the seller and merchant of record. You are solely responsible for your offers, their descriptions and prices, delivering what you promise, honouring your subscribers, handling your buyers’ questions, and all taxes and legal obligations arising from your sales.

Your content

You keep ownership of the content you upload or sell. You grant us a limited, non-exclusive licence to host, store, process and transmit that content only as needed to run the service (for example, to deliver a purchased file to a buyer, to display your storefront and catalog listing, and to review content for policy compliance).

Moderation

Digital-product files may be stored in our systems and reviewed before or after they go live. We may approve, reject, delay, hide or remove any content or offer, or suspend a creator, at our discretion — in particular where content appears to breach these Terms or the law. Trusted creators may bypass pre-review; this does not waive our right to act later.

Catalog & TOP placement

Listing in the public catalog is opt-in. Paid “TOP” placement promotes your profile for a limited time; it does not guarantee any level of sales, traffic or ranking, and we may adjust or remove placement that breaches these Terms.

4.Buyers & supporters

When you pay, you buy from the creator, not from us. What you receive (channel access, a file, or simply supporting a goal) is defined by the creator’s offer.
On-chain payments are irreversible. There are no chargebacks. Once a transfer is confirmed on the network it cannot be undone by us or by the creator.
Refunds, if any, are at the creator’s sole discretion and are arranged directly with the creator. Because PayChest is non-custodial, we cannot reverse a payment or issue a refund on a creator’s behalf.
Temporary-access products may become unavailable after their access window ends, as described in the offer.

5.Fees

Using PayChest to sell may involve a platform commission on the Free plan, and optional paid features — a Pro plan (reduced/zero commission and extra networks) and paid TOP catalog placement. Current rates, durations and any discounts are shown in the app at the time of purchase and may change. Fees for Pro and TOP are paid to the operator of PayChest for platform services and, except where required by law, are non-refundable.

You are always responsible for network (gas) fees charged by the blockchain you use; these are not set by or paid to us.

6.Crypto & payment risks

Crypto assets are volatile and transactions are permanent. You use them at your own risk.

You are responsible for sending the correct asset on the correct network to the correct address. Sending the wrong asset or using the wrong network may cause permanent loss that we cannot recover.
We rely on public blockchain nodes and wallet connection tools (e.g. TON Connect, WalletConnect) to build and verify payments; we do not control those networks and cannot guarantee their availability, speed or fees.
Nothing in PayChest is financial, investment, tax or legal advice.

7.Prohibited content & conduct

You must not use PayChest to create, sell, promote or distribute:

anything illegal where you or your audience are located;
sexually explicit / 18+ material — this is not allowed on PayChest;
content that infringes someone else’s intellectual property or privacy;
fraud, scams, deceptive offers, or impersonation of another person or brand;
malware, or content that harms, exploits or endangers others (including minors);
self-dealing or fake activity — paying yourself to inflate earnings or metrics, fake referrals, multiple accounts, bots, or any manipulation of the catalog, TOP ranking or rewards;
using PayChest purely to move funds between your own wallets, or as a currency-exchange or money-transfer tool, rather than for genuine payments between creators and supporters;
anything that abuses, reverse-engineers, overloads or attempts to circumvent the service, its moderation, or its fees.

We may remove content, cancel offers, and suspend or terminate access for breaches, with or without notice.

8.Our intellectual property

The PayChest name, brand, interface and software are owned by the operator of PayChest and protected by law. These Terms don’t grant you any right to them beyond using the service as intended.

9.Disclaimers & limitation of liability

PayChest is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free or secure, that on-chain verification will always succeed, or that any creator will deliver what they promise.

To the maximum extent permitted by law, the operator of PayChest is not liable for indirect, incidental, special or consequential damages, for lost profits, or for loss of crypto assets arising from your use of PayChest, third-party wallets or blockchains, or from dealings between creators and buyers. Where liability cannot be excluded, it is limited to the amount of platform fees you paid us in the three months before the claim.

10.Indemnity

You agree to indemnify the operator of PayChest against claims and costs arising from your content, your sales, or your breach of these Terms or the law.

11.Termination & changes

You may stop using PayChest at any time. We may suspend or end your access if you breach these Terms or to protect the service or others. We may update these Terms; the “effective date” shows the latest version, and continued use after a change means you accept it.

12.Governing law

These Terms are governed by the laws applicable at the operator’s principal place of business, without regard to conflict-of-law rules. This does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live.
